How is the document prepared?

To provide you with an Oświadczenie Na Zamieszkanie Najemcy, or the "backup address" for an Occasional Lease, the following steps must be completed:

Collection of Tenant, Landlord, and Rental Apartment Address Information (Najemca, Wynajmujący, and Adres)

Provide the first and last name, PESEL number, passport number or ID card (dowód osobisty). You can fill out the Form or send the data to info@prostoproject.pl, or submit it in person at our office at ul. Trojańska 7, 02-261 Warsaw, between 10:00 and 17:00.

The Oświadczenie will be ready within 1 day if the order is placed before 3:00 PM. You can personally pick up the notarized statement in Warsaw at Trojańska 7, 02-261, at a convenient time for you.

The owner of a property in Poland, preferring to have protection in a situation where the tenant loses the ability to pay rent and cannot be legally evicted to the street according to Polish law, often insists on signing a so-called Occasional Lease Agreement (Umowa Najmu Okazjonalnego).
A key condition for signing such a contract is having a "backup address", which is discussed below

Occasional Lease Agreement (or Temporary Lease Agreement, Polish: Umowa Najmu Okazjonalnego) is a type of rental agreement in which a specific property is named as the residence to which the tenant must move in the event of losing the ability to pay rent.

Signatures of both the landlord and the tenant on the Occasional Lease Agreement alone are not enough. The agreement must always be accompanied by a notarized declaration from the owner of the "backup" property, confirming that they will accommodate the tenant who has lost the ability to pay.

There is a certain difficulty in moving into an apartment where the owner requires such an Agreement and a notarial statement. The complexity lies in finding a second "backup owner," as not everyone is willing to take on the associated risks!
