Algorithm for Buying Property Without a Mortgage

  1. Choosing the Property
  2. The first step is selecting the right property, whether it's an apartment or a house on the primary or secondary market. Considering the average price per square meter in Warsaw (approximately 11,000–20,000 PLN depending on the district), buying a 50 m² apartment will cost around 500,000–900,000 PLN.
  3. Checking the Legal Status
  4. The buyer must verify the legal status of the property by reviewing the Księga Wieczysta (Land and Mortgage Register) to confirm ownership rights and identify any potential encumbrances. Legal verification services typically cost between 500 and 1,500 PLN.
  5. Signing the Preliminary Agreement
  6. After verifying the property, a preliminary agreement (umowa przedwstępna) is signed, which outlines the obligations of both parties. At this stage, a down payment (deposit) is usually made, amounting to about 10% of the property's price. For instance, for a 700,000 PLN property, the deposit would be 70,000 PLN.
  7. Final Agreement and Notary Fees
  8. The final purchase agreement is signed at the notary's office. Notary fees depend on the property's value and typically range from 2,000 to 3,000 PLN. Additionally, a 2% PCC tax (civil law transaction tax) is payable for secondary market properties (as of 01.10.2024, there is a proposed exemption for the PCC tax when purchasing a first home in Poland). PCC tax does not apply to properties purchased directly from developers on the primary market.
  9. Full Payment
  10. After signing the final agreement, the buyer transfers the full property price to the seller. This payment can be made through a bank account, with transfer fees depending on the bank.
  11. Ownership Registration
  12. The final step is registering the property under the new owner's name in the Księga Wieczysta (Land and Mortgage Register). This procedure costs approximately 200–300 PLN. Additional costs may arise for registering the property and updating records in the register. If buying from a developer on the primary market, registration in the land register may only be possible after construction is completed.

This costs approximately 200–300 PLN, and the process takes 4 to 8 weeks. For primary market purchases from developers, registration in the land register may only occur after construction is completed.
